CJI Surya Kant Flags Growing AI and Deepfake Threats at Delhi High Court's 60th Anniversary Celebrations

ZILLAR BARTA DESK, NEW DELHI: Chief Justice of India (CJI) Justice Surya Kant has highlighted the growing challenges posed by Artificial Intelligence (AI) and deepfake technology, calling attention to the need for greater vigilance, accountability and appropriate safeguards in the digital age.

The concerns surrounding AI-generated content, manipulated photographs, fabricated videos and misleading digital information have become increasingly important for legal institutions, particularly as technology continues to transform communication, journalism and the administration of justice.

Addressing the occasion of the 60th anniversary of the Delhi High Court, Justice Surya Kant drew attention to the changing nature of challenges confronting the judicial system. His observations come at a time when courts across the world are increasingly dealing with disputes involving digital evidence, online misinformation, privacy violations and the misuse of emerging technologies.

AI and Deepfakes: An Emerging Challenge for the Legal System

Artificial Intelligence has opened up new possibilities in several sectors, including legal research, document management, translation and case administration. However, its rapid development has also created serious concerns about the authenticity and reliability of digital information.

Deepfake technology, which uses AI to create or manipulate images, audio and videos, can make fabricated material appear genuine. Such content can potentially damage reputations, spread misinformation and create difficulties in establishing the truth during legal proceedings.

For the judiciary, verifying the authenticity of digital evidence is becoming an increasingly important responsibility. The growing sophistication of AI-generated material raises questions about how courts should assess electronic records, determine credibility and protect individuals against technological misuse.

Preserving the Integrity of Judicial Proceedings

The increasing use of AI in legal processes has also generated discussions about transparency, accountability and the limits of technological assistance.

AI-powered tools can help judges and lawyers process large volumes of information, identify relevant legal precedents and organise complex documents. These applications can improve efficiency and reduce the time required for certain administrative and research-related tasks.

However, technological assistance cannot replace the independent reasoning, experience and constitutional responsibilities of judges.

Justice Surya Kant has repeatedly emphasised the importance of maintaining a human-centred approach to technological development in the judicial system. His broader position is that innovation should strengthen the justice delivery mechanism without compromising fairness, impartiality and judicial independence.

Delhi High Court Completes 60 Years

The 60th anniversary of the Delhi High Court marks an important milestone in the history of India's judicial institutions.

Established in 1966, the High Court has played a significant role in interpreting constitutional provisions, protecting fundamental rights and resolving a wide range of civil, criminal and constitutional disputes.

Over six decades, the institution has witnessed considerable changes in the legal landscape, including the expansion of constitutional litigation, the growth of commercial disputes and the increasing importance of technology in court administration.

The anniversary also provides an opportunity to reflect on the future of the judicial system and the challenges that courts must address in an increasingly digital society.

Balancing Technological Progress with Constitutional Values

The debate surrounding AI and deepfakes is no longer limited to technological experts. It has become a significant legal and constitutional issue.

Questions relating to privacy, freedom of expression, personal dignity, data protection and the right to a fair trial are increasingly connected with the use of digital technologies.

Legal institutions must therefore develop appropriate mechanisms to address the risks associated with manipulated digital content while ensuring that legitimate technological innovation is not unnecessarily restricted.

The challenge before the judiciary is to strike a balance between embracing technological progress and protecting the principles on which the justice system is founded.

Looking Ahead

Justice Surya Kant's remarks underline the importance of preparing India's judicial institutions for a rapidly changing technological environment.

As AI becomes increasingly integrated into everyday life, courts will have to respond to new forms of disputes and evolving questions of evidence, accountability and individual rights.

The 60th anniversary of the Delhi High Court is therefore not only a celebration of six decades of judicial service but also an occasion to consider how the institution and the wider Indian judiciary can respond to the challenges of the future.

The growing influence of AI and deepfake technology has made one issue particularly important: technological advancement must go hand in hand with transparency, responsibility and the protection of justice.
